1. NATURE OF SERVICE (INTERMEDIARY ROLE)

Cogniverse operates as an Information Society Service (ISS) providing an online platform that connects individuals ("Clients") with independent coaches and psychologists ("Coaches"). You acknowledge and agree that Cogniverse acts solely as an intermediary. Cogniverse does not provide coaching, therapy, or medical services directly.

2. THE CONTRACTUAL RELATIONSHIP

When you book a session through the Platform:

• A direct contractual relationship is formed between You and the Coach.
• Cogniverse is not a party to the coaching agreement and is not responsible for the performance or quality of the coaching services provided.
• Any disputes regarding the coaching session must be resolved directly with the Coach.

3. NO MEDICAL ADVICE

The services provided by Coaches via the platform are for coaching and personal development purposes only. They do not constitute medical advice, diagnosis, or treatment. In the event of a medical emergency, please contact local emergency services immediately.

4. BOOKING AND PAYMENTS

• Facilitation: Cogniverse facilitates the booking process and payment collection on behalf of the Coach.
• Fees: You agree to pay the fees displayed at checkout.
• Cancellations: Cancellation policies are determined by the individual Coach's terms. Cogniverse, as an intermediary, will facilitate refunds only in accordance with the Coach's policy.

5. LIABILITY

To the fullest extent permitted by Dutch law, Cogniverse is not liable for:

• The quality, accuracy, or suitability of the advice provided by Coaches.
• Any actions, errors, or omissions of the Coaches.

Cogniverse’s liability is strictly limited to the technical functioning of the Platform.

6. DATA PRIVACY (BOOKINGS)

By booking a session, you agree that your name and email will be shared with your selected Coach to facilitate the session. This processing is necessary for the performance of the contract (Art. 6(1)(b) GDPR).

These Terms apply to your use of the Cogniverse website and your inquiries regarding our products, including the "Commentor" AI tool (Cogniverse Tech).

2. INTELLECTUAL PROPERTY

All content on this site, including the "Cogniverse" brand, the "Commentor" product name, logos, and software code, is the exclusive intellectual property of Cogniverse. You may not copy, distribute, or reverse-engineer any part of the website or the "Commentor" tool without express written permission.

3. "COMMENTOR" PRODUCT INQUIRIES & MARKETING CONSENT

If you choose to provide your email address to receive information about the "Commentor" product:

• Consent: You explicitly consent to receive newsletters, product updates, and promotional offers from Cogniverse regarding our technology and services.
• Withdrawal: You may withdraw this consent at any time by clicking the "Unsubscribe" link in our emails or contacting us directly.
• Nature of "Commentor": You acknowledge that the "Commentor" product is an AI-assisted tool and not a substitute for professional human judgment.

4. USER CONDUCT

You agree not to use the website to:

• Upload viruses or malicious code.
• Attempt to scrape data or gain unauthorized access to our systems.

5. DISCLAIMER OF WARRANTIES

The website and information regarding the "Commentor" product are provided "as is" without warranties of any kind. Cogniverse does not guarantee that the website will be error-free or uninterrupted.

6. GOVERNING LAW

These terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent court in the Netherlands.
